Which Mexican offices ask for this document

These are the most common procedures; the receiving office may ask for more:

Protocolización (notarial formalization) of foreign powers and documents

Notary Procedures in Mexico: Property, Estates and Companies

Office: Notario público (and, where applicable, the Public Property or Commerce Registry)
  • A power of attorney signed in the U.S. or Canada must be signed before a notary there and apostilled in that same state or province.
  • Once in Mexico it is translated by a perito, and the notario usually formalizes it (protocolización) before it is used.
  • Have the Mexican notario review the wording before you sign, so it includes the powers the transaction needs.
⏱ Validity: A power of attorney does not expire by itself, but some notarios and banks ask for recent corporate certificates or confirmation that the power is still in force.

Which version works and which does not

An apostille can only go on a public document with the right signature and seal:

✓ Accepted versions
  • Original document with the Canadian notary’s seal and certificate
✕ Versions that get rejected
  • Copies or remote electronic signatures without an accepted notarial certificate
  • Documents signed in Mexico that appear to carry a Canadian notarization
Variants of this document: Power of attorney signed in Canada before a notary (or a lawyer with notarial powers)
Step by step

How to prepare this document

Follow this order so the authority apostilles it and the Mexican office accepts it:

1

Review of the wording with the Mexican notario who will use the power.

2

Sign before a notary in the province where you are.

3

Apostille from that province, if it has its own authority, or from Global Affairs Canada.

4

Spanish translation by a perito and protocolización before a notario público in Mexico.

Apostille route

Which authority apostilles your document?

The apostille comes from a specific office, depending on where the document was issued or signed. Pick your case:

Competent authority
✓ Confirmed route

Ontario Ministry of Public and Business Service Delivery (Official Document Services)

Apostilled by Ontario Ministry of Public and Business Service Delivery (Official Document Services) (Province of Ontario).

Important: Certificates must be certified copies issued by ServiceOntario (Office of the Registrar General). Notarial and academic documents must be signed before an Ontario notary. Alberta, British Columbia, Saskatchewan and Quebec also apostille their own documents; documents from the other provinces and territories go through Global Affairs Canada. Canada has issued apostilles since January 11, 2024. An apostilled Canadian document no longer needs legalization at a Mexican consulate.

Translation

Translation by a perito traductor

Mexican offices usually ask for documents in English or French to be translated into Spanish by a perito traductor authorized by the state judiciary. The translation normally includes the apostille. Each office decides which peritos it accepts: some only take peritos from their own state.

✓ Before translating, we confirm with you which perito the office where you will file accepts.

Frequently asked questions

Apostille questions: Power of Attorney Signed Abroad

Do I have to go to the Mexican consulate in Canada?

Not necessarily. With the Canadian apostille, a power signed before a notary in Canada can be used in Mexico without consular legalization, as long as its wording meets what the Mexican notario requires.

Can I sign it in English?

Yes, and it is then translated into Spanish by a perito. Some notarios prefer a bilingual text; ask yours before signing.

Can I use a power of attorney signed before an Ontario notary in Mexico?

Yes, if it carries the apostille from Ontario’s Official Document Services and is translated into Spanish by a perito. The Mexican notario usually formalizes it (protocolización) before use, so have them review the wording before you sign.
