What to know about Texas

Details about this authority that prevent rejections and wasted trips:
Point 1
Texas borders Chihuahua, Coahuila, Nuevo León and Tamaulipas, and many families live across both countries. The Texas documents most often apostilled for Mexico are births of children of Mexican parents, marriages and divorces.
Point 2
A Texas birth certificate can be issued by the DSHS Vital Statistics Section in Austin or by the local registrar or County Clerk where the birth took place. To register the birth in Mexico, the long-form version, which shows the parents’ details, is the safer choice.
Point 3
For dual nationality of a child born in Texas there are two routes: register the child at the Mexican consulate covering the place of birth, or have the record entered (inserción) at a Registro Civil in Mexico, which does require the Texas certificate apostilled and translated by a perito.
Point 4
Divorce decrees are certified by the District Clerk of the county where they were granted. That certified copy is what gets apostilled; a notarized photocopy is no substitute at the Registro Civil.
Point 5
The Secretary of State has a walk-in counter in the Rudder Building in Austin, which helps when your appointment in Mexico is already booked. By mail, allow 4–7 business days plus courier time to Mexico.

Vital records (TX)

Texas Department of State Health Services (DSHS) Vital Statistics Section & 254 County Clerks

Location: 1100 W 49th St, Austin, TX 78756

Note: Besides DSHS, County Clerks and local registrars issue certified copies of births in their county. Check that names and dates match your Mexican record before you apostille.

Notaries public (TX)

Requirements for powers of attorney, affidavits and certified copies signed in Texas:

  • A Texas notary cannot certify copies of birth or marriage certificates or other public records; those copies come from the office that keeps the record.
  • For powers of attorney or authorization letters signed in Texas, the notary must hold a current Texas commission; the Secretary of State checks the signature before apostilling.
  • If the power of attorney will be used before a Mexican notario público, it will usually need to be formalized (protocolizado) in Mexico after it is apostilled and translated. Have the Mexican notario review the wording before you sign.

Order the right certified copy
From DSHS or the County Clerk of the county of birth or marriage; for a divorce, from the District Clerk. Compare names and dates with your passport or Mexican record.
2

The Texas Secretary of State verifies the official’s signature and attaches the apostille, by mail or at the counter.

Frequently asked questions

Questions about Texas apostilles

What people ask us about documents from Texas:

Can I apostille a Texas record in Monterrey or a border city?

No. A Mexican authority cannot apostille a U.S. document. Texas records are apostilled only by the Texas Secretary of State in Austin.

My child was born in Houston. Do I need an apostille for Mexican nationality?

It depends on where you register. At the Mexican consulate covering Houston, the birth certificate is normally presented without an apostille. If you register at a Registro Civil in Mexico, you will be asked for the Texas certificate apostilled and translated by a perito.

Is the short Texas birth certificate enough for the Registro Civil?

The safest option is the long form, which shows the parents’ details and is what is usually requested to register a birth. If you already have the short form, check with the Registro Civil before apostilling it.

I divorced in Texas. Can I remarry in Mexico?

The Registro Civil will ask for the divorce decree certified by the District Clerk, apostilled and translated. Some offices accept it as is; others may require a Mexican judge to recognize it first. Ask at the Registro Civil where you plan to marry.
